1. Scope 
1.1 For the business relationship between Griffin Nutrition Isler (hereinafter “Seller”) and the customer (hereinafter “Customer”) the following General Terms and Conditions apply exclusively in the version valid at the time of the order. 

2. Offers and service descriptions 
2.1 The presentation of the products in the online shop is not a legally binding offer, but an invitation to place an order. Service descriptions on the seller`s websites do not have the character of an assurance or guarantee. 

3. Order process and conclusion of contract 
3.1 The customer can select non-binding products from the seller`s range and collect them in a so-called shopping cart using the [add to shopping cart] button. 
3.2 The customer can then use the [Continue to checkout] button in the shopping cart to complete the ordering process. 
3.3 By clicking the [Buy] button, the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the customer can change and view the data at any time. 
3.4 The seller then sends the customer an automatic confirmation of receipt by email in which the customer`s order is listed again. The automatic confirmation of receipt only documents that the customer`s order has been received by the seller and does not constitute acceptance of the application. The purchase contract is only concluded when the seller sends the ordered product to the customer, hands it over or dispatches it within 2 days has confirmed the customer within 2 days with a second e-mail, express order confirmation. 
3.5 If the seller enables prepayment, the contract is concluded with the provision of the bank details and payment request. Payment must be made within 24 hours. If, despite the due date, the seller has not received the payment by 5 calendar days after sending the order confirmation, even after a renewed request, the seller withdraws from the contract with the result that the order lapses and the seller has no obligation to deliver. The order is then completed for the buyer and seller without any further consequences. A reservation of the article for prepayment is therefore made for a maximum of 5 calendar days. 

4. Prices 
4.1 All prices stated on the seller`s website are in CHF and do not include the applicable statutory VAT. Griffin Nutrition is currently not subject to VAT. 

5. Delivery, availability of goods 
5.1 If the product specified by the customer in the order is temporarily unavailable, the seller will notify the customer of this immediately in the order confirmation. In the event of a delivery delay of more than two weeks, the customer has the right to withdraw from the contract. In addition, in this case the seller is also entitled to withdraw from the contract. The seller will immediately reimburse any payments already made by the customer. If prepayment has been agreed, delivery will be made after receipt of the invoice amount. 

6. Payment methods 
6.1 The customer can choose from the available payment methods within the framework of and before completing the order process. 
6.2 Payment by credit cards is processed using the "Stripe" online payment service. 

7. Retention of Title 
7.1 The goods remain the property of the seller until they have been paid for in full. 

8. Material defect warranty and guarantee 
8.1 The guarantee is based on statutory provisions. 
8.2 There is only a guarantee for the goods delivered by the seller if this has been expressly given. 

9. Liability 
9.1 The following exclusions and limitations of liability apply to the seller`s liability for damages, irrespective of the other statutory entitlement requirements. 
9.2. The seller has unlimited liability insofar as the cause of the damage is based on intent or gross negligence. 

10. Right of withdrawal 
10.1 You can terminate your contract declaration to Griffin Nutrition within 24 hours without giving reasons in text form (e.g. letter, email). 

11. Returns 
11.1 Before returning the goods, customers are asked to report the return to the seller, email info@griffinnutrition.ch, in order to announce the return. In this way, they enable the seller to assign the products as quickly as possible. 
11.2 Customers are asked to send the goods back to the seller as a prepaid package and to keep the delivery receipt. The seller will reimburse the customer for the postage costs in advance, provided that these are not borne by the buyer himself. 
11.3 Customers are asked to avoid damage to or contamination of the goods. If possible, the goods should be returned to the seller in their original packaging with all accessories. If the seller is no longer in possession of the original packaging, another suitable packaging should be used in order to ensure adequate protection against transport damage and to avoid any claims for damages due to damage resulting from inadequate packaging. 

12. Return costs in the event of cancellation 
12.1 If the goods are returned due to damaged products, the seller bears the costs. Otherwise the buyer pays the costs. 

13. Storage of the contract text 
13.1 The seller saves the contract text of the order. The terms and conditions are available online. The customer can print out the contract text before submitting the order to the seller by using the print function of his browser in the last step of the order. 
13.2 The seller also sends the customer an order confirmation with all order data to the email address provided by him. 

14. Data protection 
14.1. The seller processes personal data of the customer for a specific purpose and in accordance with the statutory provisions. 
14.2 The personal data provided for the purpose of ordering goods (such as name, email address, address, payment data) will be used by the seller to fulfill and process the contract. These data are treated confidentially and are not passed on to third parties who are not involved in the ordering, delivery and payment processes. 
14.3 Further information on the type, scope, location and purpose of the collection, processing and use of the required personal data by the seller can be found in the data protection declaration. 

15. Place of jurisdiction, applicable law, contract language 
15.1 The place of jurisdiction is the registered office of the seller. 
15.2 The contract language is German.
